What are our standards and legal obligation?
Antonetti Capital is a fiduciary and, as such, we have the legal obligation to always put clients’ interests first. We must follow the highest known standard by law, the “trust” standard fulfilling the critical fiduciary duties of trust and confidence. There are five core principles associated with the Fiduciary Standard:
- Put the client’s best interests first
- Act with prudence; that is, with the skill, care, diligence and good judgment of a professional
- Do not mislead clients; provide conspicuous, full and fair disclosure of all important facts
- Avoid conflicts of interest
- Fully disclose and fairly manage, in the client’s favor, unavoidable conflicts
Are all financial and investment advisors held to the same fiduciary standard?
No. Financial Advisors (“FA’s”) at traditional brokerage firms and bank brokerage operations are held to a lesser standard when it comes to their client’s interests – a Suitability Standard. As long as the products are “suitable,” FAs have met their regulatory obligation. There may be higher levels of client care mandated by the FA’s sponsoring broker/dealer but, absent those, the minimum threshold that an FA must meet when recommending securities to clients is one of suitability. And while an FA may choose to adhere to higher standards, RIA’s remain the only advisors that are legally obligated to do so. We don’t think “suitable” is good enough. We believe investors want, and deserve, better. As a fiduciary, we embrace the fact that as an RIA we always sit on the same side of the table as the client – where the interests of our clients always come first.
Developed by the Committee for the Fiduciary Standard, a Committee formed in June 2009 by a group of investment professionals and fiduciary experts – just as policymakers and industry leaders were reviewing the repercussions of the financial crisis – to advocate that all investment and financial advice be rendered as fiduciary advice and meet the requirements of the five core fiduciary principles.
Where will my investment assets be held?
As an independent financial advisor, we use independent custodial brokerage firms (Schwab and Fidelity) to hold and safeguard our clients’ investments. As part of our firm’s policy, Antonetti Capital does not have access to, nor takes possession of, client funds or securities. Client funds and securities are at Schwab or Fidelity at all times. As an added layer of comfort, clients can have full access to their account at Schwab & Fidelity’s website and can view balances, positions, trade activity, etc. any time of their choosing. Antonetti Capital, as a fully discretionary investment advisor, buy’s and sell’s securities on the client’s behalf as part of their overall investment strategy.
How are we compensated?
Antonetti Capital Management, LLC is a fee-only registered investment advisor. We charge an advisory fee based on the amount of assets under management, typically at or less than 1% annually. We receive no commissions, no distribution fees (12b1 fees), no sales charges, no fund expenses, or any other forms of compensation. Furthermore, we do not accept gifts nor compensation from providers of investment products or investment service providers. As a fiduciary, with the legal obligation to always put the interests of the client ahead of the interest of the firm, we believe this structure fully aligns us with our client’s objectives. It also provides for an environment where there is no conflict of interest relative to a client’s goals, their overall portfolio strategy, and the selection of investment products. We remain objective as to the investment vehicle and security selection as long it is the right investment for the client, meets their investment criteria, and carries an acceptable level of risk.
Do you get paid through commissions?
In Short, No.
We are a fee-only investment adviser, which means our compensation is based only on the value of the assets we manage. As a fee-only financial advisor, we charge you a fee for our services and we’re legally obligated to act in your best interest. We don’t accept commissions from the sale of financial products or directly benefit from any transaction we make on your behalf.
This is important because avoiding commissions and transaction fees limit potential conflicts of interest when serving our clients, and we believe it frees us to deliver the best objective and unbiased advice.
